3. INTELLECTUAL PROPERTY RIGHTS

3.1 Ownership of Works

All artwork, paintings, images, photographs, illustrations, designs, graphics, logos, trademarks, trade names, text, video, audio, multimedia content, and any other creative works displayed, offered, sold, or otherwise made available on this Website (collectively referred to as the “Works”) are the exclusive property of the artist, Jose Angel Beruvides (hereinafter referred to as the “Artist”), and/or Beruvides Art Corp., and are fully protected under the copyright laws of the United States of America, the Berne Convention for the Protection of Literary and Artistic Works, the Universal Copyright Convention, and all other applicable domestic and international intellectual property laws, treaties, and conventions.

The Artist retains full, exclusive, and absolute copyright ownership over all original artwork, including but not limited to the original compositions, artistic expressions, color palettes, techniques, styles, and all elements thereof. No sale, transfer, or licensing of any product through this Website shall be construed as a transfer, assignment, or waiver of any copyright, moral right, or other intellectual property right of the Artist or Beruvides Art Corp., unless explicitly stated in a separate, duly executed written agreement.

3.2 Replicas and Reproductions — No Transfer of Intellectual Property Rights

The products sold on this Website include replicas and reproductions of original artworks created by the Artist. THE PURCHASE OF ANY REPLICA, REPRODUCTION, PRINT, POSTER, MERCHANDISE ITEM, OR ANY OTHER PRODUCT DOES NOT TRANSFER, ASSIGN, LICENSE, OR CONVEY ANY INTELLECTUAL PROPERTY RIGHTS, COPYRIGHT, TRADEMARK RIGHTS, OR ANY OTHER PROPRIETARY RIGHTS TO THE PURCHASER. The purchaser acquires only the physical product and a limited, non-exclusive, non-transferable, revocable right to possess and display the product for personal, private, non-commercial use only.

(b) You do not acquire any right, title, interest, or license in or to the underlying intellectual property;

(c) Your purchase is limited to the physical or digital product itself and does not extend to any reproduction, derivative, or other use of the intellectual property contained therein.

3.3 Prohibition of Reproduction, Distribution, and Commercial Use

Without the prior express written authorization of Beruvides Art Corp. and/or the Artist, you are strictly prohibited from:

(a) Reproducing, copying, duplicating, scanning, photographing, or digitizing any artwork, image, design, or content, whether from a physical product purchased on this Website or from the Website itself;

(b) Distributing, selling, reselling, licensing, sublicensing, renting, leasing, lending, gifting for commercial purposes, or otherwise transferring any reproduction, copy, or derivative of any artwork, image, or design;

(c) Using any artwork, image, design, or content for any commercial purpose, including but not limited to advertising, marketing, promotional materials, product packaging, merchandise production, social media content creation for commercial gain, or any other revenue-generating activity;

(d) Creating derivative works, adaptations, modifications, translations, or transformations based on any artwork, image, design, or content;

(e) Displaying, publishing, broadcasting, streaming, or publicly performing any artwork, image, design, or content in any commercial venue, publication, digital platform, or public setting for commercial purposes;

(f) Using any artwork, image, or design in connection with any product, service, brand, business, or entity without express written permission.

3.4 Limited Personal Use

Products purchased from this Website may be used solely for personal, private, non-commercial purposes, including personal display in a private residence or personal digital collection. Any use beyond personal enjoyment requires the prior written consent of Beruvides Art Corp. and/or the Artist.

3.5 Anti-Counterfeiting and Misuse Provisions

Beruvides Art Corp. takes the protection of the Artist’s intellectual property extremely seriously. Any unauthorized reproduction, counterfeiting, forgery, falsification, or imitation of any artwork, product, certificate, or other material associated with the Artist or Beruvides Art Corp. constitutes a serious violation of federal and state intellectual property laws and will be pursued vigorously through all available legal channels.

THE CUSTOMER DOES NOT HAVE THE RIGHT TO COMMERCIALIZE, REPRODUCE, SELL, DISTRIBUTE, LICENSE, OR CREATE ANY REPLICAS, REPRODUCTIONS, PHOTOGRAPHS, IMAGES, MERCHANDISE, OR OTHER PRODUCTS THAT USE, INCORPORATE, OR ARE BASED UPON THE IMAGES, ARTWORKS, DESIGNS, OR INTELLECTUAL PROPERTY OF THE ARTIST. Any such unauthorized activity may result in immediate legal action.

Each replica sold through this Website includes a numbered certificate of authenticity with a unique serial number. Any attempt to forge, duplicate, alter, or misuse this certificate is strictly prohibited and may constitute fraud under applicable law.

3.6 DMCA Compliance

Beruvides Art Corp. respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). 4.2 Replicas — Nature of Products

Products catalogued and sold on this Website as replicas are reproductions of original artworks created by the Artist. Replicas are not original works of art. However, each replica includes a certificate bearing a unique serial number that authenticates the product as an authorized reproduction produced by or on behalf of Beruvides Art Corp. and the Artist.

By purchasing a replica, you acknowledge and understand that you are acquiring a reproduction and not an original work of art. The certificate of serial number does not confer any additional intellectual property rights, ownership interests, or investment-grade value upon the product.

4.3 Color and Appearance Variations

Due to the nature of the products and the manufacturing, printing, and reproduction processes, as well as differences in display settings, screen calibrations, lighting conditions, and device specifications, there may be slight variations between the appearance of products as shown in photographs on the Website and the actual products received. 5. PRICES AND PAYMENT

5.1 Currency and Pricing

Beruvides Art Corp. offers shipping to the following regions:

(a) Domestic Shipping: The continental United States and Canada;

(b) International Shipping: Shipping to destinations outside of the United States and Canada is available on a limited basis and is subject to the availability of our logistics partner(s) and applicable shipping restrictions. Not all products may be available for international shipping. If international shipping is not available for your location, you will be notified during the checkout process.

6.2 Estimated Delivery Times

Estimated delivery times are provided for each order at the time of purchase and vary depending on the shipping destination, the shipping method selected, and the logistics provider. 6.3 Shipping Costs

Shipping costs are non-refundable except in cases where the shipment was not delivered due to an error attributable to Beruvides Art Corp.

It is the sole responsibility of the customer to provide a complete, accurate, and deliverable shipping address at the time of purchase. Beruvides Art Corp. shall not be held responsible or liable for any orders that are lost, delayed, misdelivered, returned to sender, or otherwise undeliverable as a result of an incorrect, incomplete, or inaccurate shipping address provided by the customer. If an order is returned to us due to an incorrect address, the customer will be responsible for any additional shipping charges required to reship the order.

6.5 Risk of Loss

All products purchased from this Website are shipped pursuant to a shipment contract. The risk of loss and title for products pass to you upon delivery of the products to the shipping carrier. Beruvides Art Corp. is not responsible for any damage, loss, or theft that occurs after the products have been delivered to the shipping carrier.

7. RETURNS AND REFUNDS

7.1 Return Policy

Beruvides Art Corp. offers a return policy for eligible products within fifteen (15) calendar days from the date of delivery. To initiate a return, you must contact our customer service team within this fifteen (15) day window to obtain a Return Merchandise Authorization (RMA) number and return instructions.

7.2 Conditions for Return

To be eligible for a return and refund, the following conditions must be met:

(a) The product must be returned within fifteen (15) calendar days from the date of delivery;

(b) The product must be in its original, unused, undamaged condition;

(c) The product must be in its original packaging, with all tags, labels, certificates, and accessories included and intact;

(d) The product must not show any signs of use, wear, alteration, damage, or tampering;

(e) A valid Return Merchandise Authorization (RMA) number must be obtained before returning the product;

(f) The product must be shipped back to the address specified in the return instructions.

Products that do not meet the above conditions will not be accepted for return and will be shipped back to the customer at the customer’s expense.

7.3 Non-Returnable Items

The following items are not eligible for return or refund:

(a) Digital products, including but not limited to digital books, instructional videos, and downloadable content, once accessed or downloaded;

(b) Custom or personalized products;

7.4 Refund Processing

Once a returned product has been received and inspected, and the return has been approved, a refund will be issued to the original payment method used for the purchase. Refunds will be processed within ten (10) to fifteen (15) business days from the date the returned product is received and approved. Original shipping costs are non-refundable. The customer is responsible for all return shipping costs unless the return is due to an error by Beruvides Art Corp. (such as sending a wrong or defective product).

8. CANCELLATIONS

8.1 Order Cancellation by Customer

You may request the cancellation of an order at any time prior to the order being shipped. To request a cancellation, please contact our customer service team as soon as possible with your order number and details. If the order has not yet been processed or shipped, we will cancel the order and issue a full refund to your original payment method.

Once an order has been shipped, it can no longer be cancelled, and you must follow the return policy outlined in Section 7 of these Terms.

8.2 Order Cancellation by Beruvides Art Corp

Beruvides Art Corp. reserves the right to cancel any order at any time, at its sole discretion, for reasons including but not limited to:

(a) Product unavailability or discontinuation;

(b) Pricing errors or discrepancies;

(d) Inability to verify or authenticate your identity or payment information;

(e) Violation of these Terms and Conditions;

(f) Any other reason deemed appropriate by Beruvides Art Corp.

In the event that we cancel your order, you will be notified by email and a full refund will be issued to your original payment method.

9. LIMITATION OF LIABILITY

9.1 General Limitation

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BERUVIDES ART CORP., ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, CONTRACTORS, AND THE ARTIST SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF BUSINESS, LOSS OF GOODWILL, OR LOSS OF OPPORTUNITY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE WEBSITE, ANY PRODUCTS PURCHASED THROUGH THE WEBSITE, OR ANY CONTENT, MATERIALS, OR INFORMATION OBTAINED FROM THE WEBSITE, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF BERUVIDES ART CORP. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2 Shipping Delays

Beruvides Art Corp. shall not be held responsible or liable for any delays in shipping or delivery caused by circumstances beyond our reasonable control, including but not limited to:

(a) Natural disasters, including but not limited to hurricanes, earthquakes, floods, tornadoes, wildfires, and severe weather events;

(b) National or regional emergencies, pandemics, epidemics, quarantines, or government-imposed restrictions;

(c) Carrier delays, logistics provider failures, transportation disruptions, labor strikes, or supply chain interruptions;

(d) Government actions, customs delays, import/export restrictions, or regulatory actions;

(e) Any other force majeure events or circumstances beyond the reasonable control of Beruvides Art Corp.

9.3 Color and Printing Differences

Beruvides Art Corp. shall not be responsible or liable for any minor differences in color, hue, saturation, brightness, texture, finish, or appearance between the products as displayed on the Website and the actual products received, as outlined in Section 4.3 of these Terms.

9.4 Product Use

The use of any product purchased from this Website is entirely at the customer’s own risk and responsibility. Beruvides Art Corp. makes no representations or warranties regarding the suitability of any product for any particular purpose and shall not be liable for any injury, damage, or loss resulting from the use, display, or handling of any product.

The customer assumes all legal risks associated with any unauthorized use of images, photographs, artworks, designs, or any intellectual property of the Artist or Beruvides Art Corp. Without limiting the generality of the foregoing, the customer is strictly prohibited from:

(a) Reproducing, copying, or creating replicas of any artworks, images, or designs;

(b) Using any images, photographs, or artworks for commercial purposes;

(c) Manufacturing, producing, or selling any products that incorporate, feature, or are based upon the artworks, images, or designs of the Artist;

(d) Posting, sharing, or distributing any photographs or images of the artworks for commercial gain.

Any unauthorized reproduction, distribution, commercialization, or use of the Artist’s intellectual property by the customer or any third party may result in legal action for copyright infringement, trademark infringement, and any other applicable claims, with the customer being held responsible for all damages, losses, attorneys’ fees, and costs.

9.6 Maximum Liability

IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF BERUVIDES ART CORP. FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, THE WEBSITE, OR ANY PRODUCTS PURCHASED THROUGH THE WEBSITE EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO BERUVIDES ART CORP. FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM.

10. DISCLAIMER OF WARRANTIES

THE WEBSITE AND ALL PRODUCTS, CONTENT, MATERIALS, INFORMATION, AND SERVICES PROVIDED THROUGH THE WEBSITE ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. BERUVIDES ART CORP. DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. BERUVIDES ART CORP. DOES NOT WARRANT THAT ANY DEFECTS WILL BE CORRECTED OR THAT THE WEBSITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Beruvides Art Corp., the Artist, and their respective owners, officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or in connection with:

(a) Your use of or access to the Website;

(b) Your purchase or use of any products obtained through the Website;

(d) Your violation of any applicable law, regulation, or third-party right;

(e) Any content, information, or material you submit, post, or transmit through the Website;

(f) Any unauthorized use of the Artist’s intellectual property.

12. GOVERNING LAW AND DISPUTE RESOLUTION
